Right to Opt-Out of “Sales” or “Sharing”

The California Consumer Privacy Act (“CCPA”) provides California residents with the right to opt out of the “sale” or “sharing” of their personal information. The CCPA defines a “sale” of personal information as disclosing a California resident’s personal information to a third party for monetary or other valuable consideration. Where such disclosure is for cross-context behavioral advertising, whether or not for monetary or other valuable consideration, it qualifies as “sharing” under the CCPA.

Like many online retailers, we work with third party advertising partners to help us promote our products and identify potential new customers, including through interest-based advertising. Under the CCPA, some of these activities are classified as “selling” or “sharing” personal information for cross-context behavioral advertising.
